1. Definitions:

• Cashback means the applicable Cashback value specified in the Eligible Products table below, in the form of a Prepaid eftpos card.
• Cashback Value means the Cashback Value specified in the Eligible Products table below corresponding with the relevant Eligible Product.
• Customer means the purchaser of the Eligible Product, as specified on the related order and invoice.
• Eligible Customer means a Customer who qualifies for a Cashback under these Terms; Eligible Product means any product listed in the Eligible Products table below, purchased and paid for in full, from a Liebherr Chartered Agent in Australia during the Offer Period, excluding any Ineligible Product or Ineligible Purchases, and delivered to the Customer in accordance with these Terms.
• Ineligible Product means any project or commercial purchases, trade seconds, scratch and dent stock, discount clearance outlet purchases, ex-display or used stock.
• Prepaid eftpos Card means an eftpos gift card pre-loaded with the Cashback Value.
• Promoter means Andi-Co Australia Pty Ltd (ABN 68 005 899 365), located at 1 Stamford Road, Oakleigh, Victoria, 3166.
• Promotion means this cashback promotion operated by the Promoter.
• Terms means these terms and conditions.

2. Eligibility: To be eligible for the Cashback, the Customer must:

• (i)purchase the Eligible Product(s) during the Offer Period;
• (ii)pay for the Eligible Product(s) in full within 90 days of the date of order.

3. Nature of Cashback: The Cashback will be in the form of a Prepaid eftpos card to the value of the applicable Cashback Value for the relevant Eligible Product as shown in the above Eligible Products table. The Prepaid eftpos card will be sent to the Customer by normal, pre-paid post to the Customer’s address specified on the order and invoice for the Eligible Product. The Prepaid eftpos card will be sent to the Customer’s address no later than 120 days after the Promotion end date.

4. Cashback Exclusion: The Cashback Promotion is not available in conjunction with any other promotional offer.

5. Privacy: The Promoter collects personal information (PI) in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, and, as required, to Australian regulatory authorities. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at www.andico.com.au. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Customer. The Privacy Policy also contains information about how Customers may opt out, access, update or correct their PI, how Customers may complain about a breach of the Australian Privacy Principles or any other applicable laws and how those complaints will be dealt with. Unless otherwise indicated by the Promoter, the Promoter may disclose PI to entities outside of Australia (for a list of the countries, see the Promoter’s Privacy Policy). 

6. Award: On and subject to these Terms, every Eligible Customer will be awarded a Cashback for their purchase of an Eligible Product. Funds are issued in Australian dollars only. Cashbacks are not transferable, exchangeable, redeemable for cash or assignable, unless agreed by the Promoter in writing.

7. Cancellations & Returns: If an Eligible Customer receives a Cashback and later cancels the order or returns the Eligible Product (within terms and conditions of sale) the subject of their Cashback redemption, then to the maximum extent permitted at law the amount credited or refunded to the Eligible Customer will be the amount paid for the Eligible Product less the Cashback amount.

8. Reservation of rights: The Promoter reserves the right to bring forward, or extend, the closing date for the Promotion at its discretion. The Promoter’s decision on all matters pertaining to this Promotion are final and binding, and no correspondence will be entered into.

9. Liability: Nothing in these Terms limits, excludes or modifies or purports to limit, exclude or modify and Federal or State legislation relating to the supply of goods or services that cannot be limited, excluded or modified. To the maximum extent permitted at law, the Promoter (and its agents, employees, officers and representatives) excludes all liability for any damage or loss of any kind whatsoever, or any personal injury, arising from:

• a. the Promotion;
• b. any theft, unauthorised access, or third party interference;
• c. any tax liability incurred by a a party to whom a Cashback is awarded; or
• d. redeeming or taking a Cashback.

10. Cancellation: If for any reason this Promotion is not capable of running as planned, the Promoter reserves the right to cancel, modify, suspend or terminate this Promotion.

11. Laws: These Conditions will be governed by and construed in accordance with the laws in force in Victoria, Australia. All parties submit to the non-exclusive jurisdiction of the courts of Victoria, the Federal Court of Australia, and the courts entitled to hear appeals from those courts.
